EPA’s Water Grab Act
Today I’m flying the Fort Moultrie flag. I fly it when there is “liberty-risky” discussion. and such a discussion is happening right now. Once again the EPA is reaching out to control our lives, supported by the Democrats and Obama as usual. This time they want to control ALL of the water in the USA … not just “navigable water” as they previously controlled.

Water Grab Act
Government Power Grab: It isn’t enough that the EPA has declared CO2 a “Hazardous” gas … giving them jurisdiction over everything with a carbon emission from smokestacks, to cow farts, to the emissions of your lawn mower? (See S.T.O.P. the EPA). Now they want to control all water … and yes, they can regulate a mud puddle with this power. The intrusion of this government into our personal liberties and freedoms is breathtaking … and so far, the abundance of American Ignorance is allowing them to get away with it! So let’s “wise up” and get with what is going on … here’s the facts: (pass them on!). The official name of this legislation is the Federal Water Pollution Control Act or FWPC or FWPCA.
Bill Summary: There are two pieces of legislation on this: H.R. 2421 and S 787. Here is the summary for S-787:
Thomas Summary of S-787 Clean Water Restoration Act – Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to replace the term “navigable waters” that are subject to such Act with the term “waters of the United States,” defined to mean all waters subject to the ebb and flow of the tide, the territorial seas, and all interstate and intrastate waters and their tributaries, including lakes, rivers, streams (including intermittent streams), mudflats, sandflats, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, natural ponds, and all impoundments of the foregoing, to the fullest extent that these waters, or activities affecting them, are subject to the legislative power of Congress under the Constitution.
Heartland.org: “By eliminating one word–navigable–and replacing it with the term ‘waters of the United States,’ the legislation would give the federal government authority over anything that is wet, as well as any activity on land that could affect water,” explained the North Carolina Coalition for Clean Water in a December 18 news release. “When the word ‘navigable’ is taken out, [it makes] everything federal water–without regard to volume and flow. That means gutters, ditches, seasonal wet spots, even groundwater.

There is Nationwide Opposition
Heartland.org: Opposition to the federal proposal was expressed on December 5 when members of Congress, state legislators, the National Cattlemen’s Beef Association, Property Rights Alliance, Partnership for America, and Americans for American Energy joined the National Farm Bureau Federation, American Property Coalition, and Western Business Roundtable on the steps of the Longworth House Office Building in Washington, DC.
Strong opposition also has been expressed outside of Washington in town meetings, state capitols, and newspaper editorials across the country. “The scope of this legislation is breathtaking,” said Larry Wooten, president of the North Carolina Farm Bureau. “It will raise costs for farmers and homeowners while also burdening state and local governments.”
“With these changes,” Youngberg said, “ordinary roadside ditches, stock tanks, and ponds would be subject to extensive regulation and permitting. Even low spots in fields farmed for decades would be subject to extensive reviews.”
Even John Dingle (D) doesn’t like it!
“Most of the ducks that migrate across our skies in the spring and fall are hatched and raised on prairies,” Dingell asserted. “Remove [the puddles] and you remove the ducks,” Dingell claimed.

Never before in the nation’s history has federal power reached so far! Included is a citizen lawsuit provision that allows anyone to sue you if they think your activity might affect water (defined as nearly dry land). Supporters include the Sierra Club, Earthjustice, Greenpeace, the Natural Resources Defense Council and dozens of other radical anti-property, anti-free market, and anti-use organizations. The Bottom Line

Liberty being Broken!
It is about control! Under the familiar guise of “save the earth” and “love the animals” … for OUR protection, the government is trying to take control of another KEY ASPECT of our lives … water! All water! Before, the term “navigable waterway” defined the boundary of federal vs state control of water. With the changing of these two words, the federal government is reaching out to control the rain water you walk through on a cloudy day. This legislations gives them control over ANYTHING affecting the water. So to build something “near by” you will need over 100 permits from the EPA to prove that you will not be contaminating whatever “water” is in question.
- And what about “existing” water? There’s no grandfather clause … if the water is “suspected” to be contaminated by a nearby activity, (a cow urinating in a meadow?) … the activity can be “regulated!” Yes, because the bill’s wording states control of “lands adjacent to the water.” So the “control” climbs up onto the land … its not only a “water grab” its a “land grab”too!
Keep Waking Up, America! The socialist coup which has happened was allowed to happen because of ignorance and apathy. To S.T.O.P. it in its tracks, people are going to have to get off their duffs and start paying attention and getting involved.
