Today at 11:15 am the President of the United States signs the Health Care Bill that most of the people in the United States oppose. This is being signed in defiance of the will of the people.  So taking over 1/6th of the US Economy by the government will be achieved today.  Own 20% of anything and you will control it.  This is the greatest defeat of Liberty and Freedom since the original War for Independence.  Now, what will Americans do about this?  What will happen next?  We are about to find out if the “Democratic Republic” still works and is viable.  Our fundamentals have been attacked, can/will they be defended and preserved?

• Three fundamentals for Challenge:
• Does it conflict with what the Constitution says?
• Does it conflict with what the Supreme Court has said?
• Will five justices accept a particular argument?

• The Slaughter Rule: As early as 1933 House rules were interpreted to permit House acceptance of Senate Amendments in a bill simultaneously with House passage of a Resolution on a separate matter. But that precedent clearly included House concurrence in (or “passage” of) the Senate Amendments. The new maneuver planned for this week’s health care bill is not designed to be an up or down vote on Senate Amendments to a bill or a bill itself. Instead the proposed Rule will “deem”, or pretend, that a Senate bill that will never have been in fact “passed”, was instead “deemed” to have been passed.
  • The United State’s Constitution says: “Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States.“

• Unconstitutional Grounds: It is believed it is NOT Constitutional to force a citizen to pay for something with the penalty of a fine for non-compliance.  This is the point that will be argued at the Supreme Court level.

The Legislative Challenge – (Repeal & Nullification)

• Repeal the Bill
  • Sen. Jim DeMint (R-S.C.) introduced a bill calling for repeal of the bill on Monday morning, characterizing health care reform as an “arrogant power grab.”

• Nullification (10th Amendment)
  • Several states are planning to invoke the 10th amendment (nullification, State Sovereignty) to block the federal mandated funding.  South Carolina, Virginia and Florida are initiating action.
  • Along these same lines, as of this writing 36 states have joined in a lawsuit to nullify health care saying it is unconstitutional. (See unconstitutional grounds above).

The Citizen Uprising:

• The indicators …
  • Approval Ratings: Pelosi approval at 8%, Reid at 11%, Obama at minus 12 disapproval with 53% strongly disapproving of his performance.  These are not people who are “loved” as leaders of the Republic, poll numbers indicate the public rejects them.
  • Listening to the People: In spite of 55% of people NOT in favor of the bill, the Democrat congress passed it anyway, and it was not a “pretty” passage using the nuclear option (reconciliation) or a legislative “trick” to make it happen..
  • Lies are Exposed: People are becoming aware of the lies used to pass these bills. An example is the $500 billion to be saved over the next 10 years by cleaning up Medicare. (Why didn’t they clean it up first and “fund” this bill with the savings?).  People are “seeing” the lies clearly and approval for leadership is waning.
  • The methodology was corrupt. Backroom deals (Landreau, Nelson, etc), rule maneuvering in the congress, total LACK of Transparency (“It will be on C-SPAN), Closed door meetings, complete breakdown of any attempt for bipartisan. (You either go along with the Democrats, or they will do it without your input).
  • (updated 3/28/2010)  The Stupak 11 were given $4,700,000,000 (BILLION!) in earmarks for their “yes” vote on the final bill. Read about it HERE.
• The reaction …
  • The Tea Party Movement is already in place and should be given a great deal of additional strength with the passage of this Health Care Bill.  There were “fundamental ideological” differences for which to protest, but now there is a concrete foundation from which to shout and organize.
  • The Internet as an Indicator … trust it or not, the Internet is “on fire” with this topic. Drudge had the 2nd highest number of “hits” in their history Monday.  There is huge anger for its passage, and huge approval from the left for the passage … there seems no “middle ground” … lines are drawn and, minds are “made up”.  If the Internet is an indicator, there is a significant conflict in the making.
  • The Polls … the polls continue to show there may be a revolution in the voting booth in November. Unchallenged Democrats are “retiring early” and others have little or no chance of being re-elected showing themselves to be far behind in polls with challengers.  With 56% of the people disapproving of this legislation, the “seeds” for revolution are planted.

As long as Obamacare is viable, Socialism is viable. So what are the options?

• Repeal: Not possible.  We did not have the votes to stop this, and we then certainly will not have the necessary votes to repeal it … even less a chance to over ride a veto by the President.  In the short run, this is simply salve on a terminal wound.  In the long run there could be a political effect. When the repeal is rejected by the Democrat-controlled congress, the Republicans will be in excellent position for re-election and for election to Democrat-held seats. With that sort of mandate, repeal could pass … but AFTER NOVEMBER 2010.  But then it would take a 2/3rd majority to override a Presidential veto.  Meaning the only time this could be repealed is with a Republican-held congress and a Republican President … that is 2012 … exactly when the “benefits” of health care start kicking in … another “payoff” for votes … planned and timed as such.

• Legal Challenges may take too long: These will take time, and with the “attention deficit syndrome” of the American Public, 6 months from now they may forget what the challenge is all about and have to be “re-educated.”  Also, with one more Supreme Court judge appointed by Obama, the Republic is surely lost. He has the votes to confirm the nomination and he could put a pure Communist in there and it would pass this congress. My greatest fear now is this next SCOTUS nomination.  There is also a SCOTUS wild card that could very easily change America forever. If one of the Supreme Court Judges steps down … Obama could put a declared Communist on the court and it could not be stopped.  If we lose a conservative Supreme Court judge between now and November … the end of America could very well be finalized.

• Citizen Uprising: IF (and that’s in caps) this is stopped or reversed, it will only happen if the people rise up and take the power away from the people who are mishandling it.  We tend to think that couldn’t happen now, but our history in the United States says otherwise.  It looks like the revolution will happen in the voting booth in November, the polls are all showing these people will be thrown out of office.  I hope and pray this is the extent of the revolution.  However, if this ideological direction is allowed to proceed beyond November, then I believe there will be consequences. I do believe, in some way, the American Public will rise up and forcefully take the power away from the “leadership” that is not responding and replace them with leaders who will do the will of the people.

The Sons of Liberty did it once before … dressing up as Indians and storming a ship to throw the tea into the sea. Civil disobedience was the only way to throw off the tyranny of an oppressive government.  There is written consensus on this subject in the following documents at “The Land of the Free“:

Declaration of Independence “That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness”

Conclusion: We “changed” it once before in our history, is the time coming to change it again? Obamacare is the clear and visible marker that Socialism has been initiated in the United States.  And it was done with “legislative Democrat-driven force” not with bipartisan discussion. We have now exploded the myth that there are “moderate” Democrats.  There are NONE … there are no “Pro Life” Democrats, no “Blue Dog” Democrats. They are all Socialists and support the socialist takeover of our Republic. Their overwhelming vote for Obamacare makes this a fact.

So they are now all “Socialist Democrats“

… a term I will use from now on in conversations and writing.

The will of the people was not a factor in this process.  In spite of millions of emails and calls and petitions and rallies … the Socialist Democrats did what they wanted, not what the people wanted.. The passage of this bill is the beginning of Obama’s “transformation of America” and the Socialist Democrats supported this bill and made it pass. If you vote for Socialism, then you are a Socialist.  There are no Democrats (from our fathers’ party left).  Obamacare is the marker, if it stands, Socialism stands and the Republic will no longer be a Republic.

So in the end, the courts may play a role (much later), legislative repeal may happen (much later) … and all “”so much later” that the installed programs and debt cannot be reversed.  That leaves one option … the will of the people being heard and the will of the people causing them to take action and that action should start immediately.  What action? The first action must be to vote them out in November. But if the judicial wild card occurs before November other action will be necessary. Who knows what form that would take? But most Americans will not stand for…

As you have seen, the law will not stop them, the Constitution will not stop them, hoping that they will do the right thing will not stop them because their definition of “the right thing” has nothing in common with ours.”
